Citations questions

Short answers for supervisors and safety leads.

How long do I have to contest an OSHA citation?

Under federal OSHA, you have 15 working days after receiving a citation to file a written notice of contest. You can request an informal conference during that period, but it does not extend the deadline. In Michigan, where MIOSHA covers most employers, you have 15 working days after receiving a citation to petition MIOSHA for an informal appeal, and a further 15 working days to appeal the department’s decision.

Can an employer refuse an OSHA inspection?

Federal OSHA recognizes the employer’s right to require compliance officers to obtain an inspection warrant before entering. If entry is refused, OSHA can seek a warrant or other legal process. Most companies are better served by cooperating, staying professional and accompanying the inspector throughout the visit.
